TERMS AND CONDITIONS
The General Terms and Conditions of the online shop www.lotussafe.com are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1, ZVOP-2) and the Electronic Communications Act (ZEKom-1). The website is operated by the company Poslovno svetovanje, Luka Verdnik s.p., Breg pri Polzeli, Pod bregom 73, 3313 Polzela, registration number: 8577765000, tax number 72483822 (the company is not subject to VAT), which is also a provider of e-commerce services (hereinafter also referred to as the Seller). The company is registered with the District Court in Celje on 07.01.2020.
The General Terms and Conditions of Business govern the operation of the website, the online shop, the rights and obligations of the user and the shop, and regulate the business relationship between the seller (Luka Verdnik s.p.) and the buyer (user). The Buyer is bound by the General Terms and Conditions in force at the time of purchase (placing an online order). When placing an order, the user is specifically reminded of the General Terms and Conditions and confirms his/her knowledge of them by placing the order.
Payment method
When placing an order, the buyer can choose between the following payment methods:
- payment by invoice
- payment to the company’s bank account
- payment on delivery
- payment on collection in person
Delivery
- The delivery charge is calculated according to the weight of the package according to the current price list of the provider.
GLS Slovenia
. - Delivery is carried out by GLS Slovenia. If you place an order today, the package will be delivered within 3 working days and will reach you no later than the 5th working day after placing the order. No delivery on Saturdays, Sundays or public holidays.
- We do our best to keep the stock in the online shop up to date. However, stock shortages may occur and the buyer will be notified no later than 2 working days after the order is placed. In this case, we will inform the user of the situation and do our best to accommodate their wishes. We can offer another, similar product, order it quickly from the supplier, or refund the purchase price if payment has already been made.
- After you have received notification of the preparation of your shipment from the provider, you will receive your order number. Using the number you receive, you can track your package on the GLS Slovenia website. You can check the status of your shipment here –

Return of goods
The consumer has the right to withdraw from the contract within 30 days of taking delivery of the goods, without having to give a reason, by sending an email to info@lotussafe.com. The deadline starts one day after the date of receipt of the product. The only cost to the consumer of withdrawing from the contract is the cost of returning the goods. The goods must be returned to the seller no later than 30 days after the date of the cancellation notice.
The consumer does not have the right to withdraw from a contract where the subject-matter of the contract is goods which have been manufactured according to the consumer’s precise instructions, which have been tailored to the consumer’s personal needs, which are by their nature unsuitable for return, which are perishable or which have reached the end of their useful life.
The Buyer shall be liable for diminution in the value of the goods if the diminution in value is due to handling which is not strictly necessary to establish the nature, characteristics and functioning of the goods. The consumer shall not be liable for any diminution in the value of the goods if the company has not informed him of his right of withdrawal in accordance with 4. Article 43b(1), point 1 of the PPSO.
In the event of withdrawal from a contract where a bonus, discount code or promotional code has been used, these funds will be taken into account as a discount and will not be refunded to the user. Only the amount paid will be returned to the user’s TRR.
Refunds of payments made will be made as soon as possible, but at the latest within 14 days of receipt of the cancellation notice. In order to ensure the certainty, accuracy and timeliness of the repayment and to provide a record of payments, the repayment of the payment to the consumer shall be made by the same means of payment as used by the consumer, unless the consumer has expressly requested the use of another means of payment and unless the consumer bears no costs as a result.
The return of the goods received to the company within the withdrawal period shall be deemed to be a communication of withdrawal from the contract.
The form for withdrawal from the product contract shall be forwarded by the seller, Luka Verdnik s.p., to the user within a maximum of 2 working days after receipt of the information about the withdrawal from the contract by the consumer.
The right to reimbursement of the purchase price, warranty, material defects and incorrectly rendered services is regulated in more detail by the following provisions

Purchase procedure
- Both registered and non-registered users can shop at www.lotussafe.com.
- A basket overview is available to the user at all times when browsing the shop www.lotussafe.com/shop/
- Before the final order is placed, the customer is given a complete overview of the order and also the possibility to scroll back through the online order and remove any products.
- Information on the status and content of the order is always available to the user on the www.lotussafe.com website.
- Registered and non-registered users receive an order summary at the time of their order to their email address.
- The Provider shall store the content of the orders of registered and non-registered users.
1. ORDER ACCEPTED
After the order is placed, the buyer receives a summary of the order by email and a notification that the order has been accepted in the provider’s IT system.
2. ORDER IN PROCESS
The order goes to further processing and is given the status “in process”. The Tenderer shall examine the order, check the deliverability of the items ordered and confirm the order or reject it with a reason. We do our best to keep the stock of products in our online shop up-to-date, but errors can still occur and the product you want may be out of stock. In this case, we will do our best to ensure delivery of the product or refund the purchase price. The Supplier may call the Buyer’s contact telephone number to verify the information or to ensure the accuracy of the delivery.
3. ORDER COMPLETED
Within the agreed time limit and upon receipt of payment via invoice, the Supplier prepares the goods, dispatches them and notifies the Buyer by e-mail. Once the package has been dispatched, the order is given the status “completed”. The buyer receives an invoice for the goods purchased, which is enclosed with the shipment.
Protection of personal data
At Luka Verdnik s.p. (“LOTUS SAFE” or “we”), we understand and support the importance of data privacy for our customers. We treat all personal data you provide to us fairly and protect it carefully in accordance with the applicable regulations of the Republic of Slovenia, the European GDPR and the principles and vision of the company.
We collect, store and process your data in the most careful way possible. Only the owner of Luka Verdnik s.p., her spouse and the website designer can access your personal data. All other external employees of the company, if any, shall have access to any personal data of the client/buyer/consumer only to the extent and for the purpose necessary for the smooth performance of the work and sales processes and marketing purposes in accordance with the consent.

How we handle your personal data
- We sell our products through our online shop www.lotussafe.com (hereinafter referred to as “the Website” or “the Online Shop”).
- We emphasise a personal and honest approach when selling our products, and all decisions are made in line with our company values of care, precision and responsibility towards our customers. We also act in accordance with our ethics in the protection of our customers’ data, as we are aware of the trust that our customers place in us by handing over this data and the responsibility that this data brings. We are therefore committed to a lawful and fair approach to the processing of personal data, which includes restricting access to data.
- Your personal data may only be accessed by the owner of the company Luka Verdnik s.p., his/her spouse, the designer of the website and authorised subcontractors with whom we cooperate for the purpose of technical support. These are:
- online advertising providers on Facebook and Instagram;
- website and IT service maintainers and web interface maintainers
- developers and implementers of software solutions;
- Post Slovenije delivery service
- by public authorities or other legal persons where there is a legal obligation to do so.
All authorised subcontractors have a Personal Data Processing and Protection Agreement.
We may also disclose your personal data to third parties on an exceptional basis, but only where non-disclosure would cause general or personal damage to you or where you yourself request that we disclose your personal data to a third party.
How we obtain your personal data
We accept personal data in the following ways:
- When you sign up for the newsletter using the form on the website www.lotussafe.com
. uploaded to the main electronic database using MailChimp within 1 day. - By registering online at www.lotussafe.com using the online form. With this registration method, your data is transferred to the main electronic database within 1 week.
- When using the www.lotussafe.com website and all its sub-sites. This involves the use of web cookies to collect data, which you can read more about below.
- Occasionally through prize draws and activities, whereby the user is always made aware of the purpose for which personal data is collected and used.
- Through social networks and other marketing tools such as apps, where the consumer is always aware of the purpose of the collection and use of personal data.

We collect and store the following data for further use and processing:

- other information you provide in the context of your self-initiated enquiry (which products you are looking for or viewing in our online shop).
Purposes of the processing of personal data and legal basis
We collect and process personal data for our own sales and promotional purposes through our online shop in the European Union and the rest of the world. We collect data for the following purposes:
- email updates, notifications and product information
- provide the services you have requested (such as sending you online newsletters, notifying you of product re-availability, etc.) via the medium you have chosen (such as an email or a phone number);
- sales and transactions in the purchase process via the online shop or through enquiries you send us by email, via social networks or express in person at our offices;
- managing your participation in various advertising activities (such as prize draws, surveys, etc.);
- the performance of our contract with you in the process of purchasing from our online shop (e.g. for the delivery of products you have purchased from our online shop);
- the performance of other obligations you have agreed with us;
- Compliance with legal requirements (e.g. for invoicing);
- identity verification to avoid fraud;
- ensuring that the content and functionality of the website is tailored to your preferences and needs as much as possible;
- display relevant ads on social networks (e.g. Facebook and Instagram);

How we record data on our website
When you visit the website, certain information is collected for the best possible performance, to ensure quality and to collect general usage statistics – this is information about your device, which is recorded through cookies and code embedded on the website. This information may include information about the type of device you use to browse (mobile phone, tablet, PC or other), your IP address, browser type and operating system, your activity on our website (e.g. which subpages you visited, how you moved around the website, how long you spent on each page, etc.).
All the data we receive from your visit is expressed only in the form of an identification number, which means that we cannot identify the actual personal data of the user from it. Your data that we receive from your visit to the website is therefore secure; in order to access the exact data, we would need your personal permission (e.g. to provide your e-mail address to subscribe to our newsletter).

In this case, your data is used to enable the social network to show you the ads that are most interesting to you based on the activity detected.
c) Google Analytics
We use Google Analytics to collect data about the status and traffic of the website. The data collected by the tool relates to your use of the website (e.g. your start URL, screen resolution, the browser you use, etc.) and is stored and analysed on a Google server. All this data is available to us via Google Analytics, but only in an anonymised form. d) User-generated content
Users can submit product reviews on the website. This requires you to choose a title of your choice, which is then made public – we recommend that you choose the title you wish to be displayed with accordingly in order to protect your personal data. An e-mail address is required when posting a comment, but is not publicly displayed. You should be aware that the opinion will be made public on our website and, where appropriate, for promotional purposes, on the LOTUS SAFE Facebook or Instagram profile.
In addition to the above-mentioned possibilities of obtaining data as a result of the operation of the website, we obtain your personal data exclusively through your active enquiry or order (e.g. when you place an online order).
How long do we keep your personal data?
We will protect your personal data as long as there is an interest/need to do so or until you withdraw your consent. In cases where the processing and retention of data is based on a contract or is provided for by law, the retention period shall be adapted to the contract or law. If there are reasonable grounds to suspect that the data entered is untrue, we reserve the right to delete it from all databases without notice.
What are your rights?
You have the right to request at any time, without justification or consequence, that we complete, rectify or restrict the use of your data or that we permanently remove it from our database. You can also request access to or object to the processing of your personal data and request the transfer of your data. The withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until its withdrawal. If you believe that your personal data is being stored or processed in breach of the applicable regulations governing the protection of personal data, you have the right to lodge a complaint with the Information Commissioner of the Republic of Slovenia.
You can request the complete deletion of your personal data from our system in the following ways, clearly specifying the content of your request:
- send your request in writing by email to info@lotussafe.com with the subject “Opt-out”;
- send your request in writing by ordinary post to Luka Verdnik s.p., Breg pri Polzeli, Pod bregom 73, 3313 Polzela, company registration number: 8577765000, tax number 72483822. Upon receipt of your request, we will stop processing your personal data within 5 working days.
Although we are committed to the security of your data, due to various factors beyond our control, the flow of information over the internet may not always be completely secure and consistent with our operations. Please take care when entering the information you send us via the online forms and do so responsibly.
Material defects and complaints
The provider is liable for material defects of products purchased in the online shop www.lotussafe.com. The user shall report the complaint to info@lotussafe.com. The user must describe the defect in more detail in the defect notification and give the supplier the opportunity to inspect the product.
The goods with a copy of the invoice and a description of the defect shall be sent by the user to the address of Luka Verdnik s.p., Breg pri Polzeli, Pod bregom 73, 3313 Polzela, registration number: 8577765000, tax number 72483822, within 14 days after the written message has been sent.
The Supplier will acknowledge receipt of the complaint and provide a written response to the complaint within 8 working days of the written communication from the Buyer.
The user may notify us of a claim for a material defect within two months of the date on which the defect was discovered.

Complaints and disputes
The Provider complies with applicable consumer protection legislation. The provider shall make every effort to comply with its obligation to set up an effective complaints handling system and to designate a person whom the user can contact by telephone or e-mail in the event of problems. The complaint should be submitted via email to info@lotussafe.com. The complaint procedure is confidential.
In accordance with the legal norms, we do not recognise any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a consumer may bring under the Act on the Out-of-Court Settlement of Consumer Disputes.
